Description

  • Der X. Zivilsenat des Bundesgerichtshofs hat auf die mündliche Verhandlung vom 23. Januar 2008

    für Recht erkannt:
    Auf die Berufung der Beklagten, die im Übrigen zurückgewiesen wird, wird das am 8. Mai 2003 verkündete Urteil des 2. Senats (Nichtigkeitssenats) des Bundespatentgerichts abgeändert und wie folgt neu gefasst:
    Unter Abweisung der weitergehenden Klage wird das europäische Patent 548 475 mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland im Umfang seiner Patentansprüche 1, 4 bis 17 sowie 18 bis 23, soweit letztere nicht auf Patentanspruch 2 oder Patentanspruch 3 rückbezogen sind, für nichtig erklärt.

Claims (23)

  1. Nichtig
  2. Sohle gemäß Anspruch 1, dadurch gekennzeichnet, daß die Komfortschicht (8) aus einem nachgiebigen Material hergestellt ist, das eine Dichte aufweist, die progressiv von ihrem oberen Teil in Richtung ihres unteren Teils ansteigt, der im Kontakt mit dem steifen Zwischennerv (9, 9A, 9B, 9C, 9D, 9E, 9F) ist.
  3. Sohle gemäß Anspruch 1, dadurch gekennzeichnet, daß die Komfortschicht (8) aus mehreren unterschiedlichen benachbarten Bereichen zusammengesetzt ist, wobei ein erster Bereich (8a) mit großer Elastizität der Ferse entspricht, wobei ein zweiter Bereich (8b) mit mittlerer Elastizität der Fußsohlenwölbung entspricht und die Zirkulation des Blutes begünstigt und wobei ein dritter Bereich (8c) mit geringer Elastizität die Kontrolle des Gehens begünstigt.

  18. Sohle gemäß irgendeinem der vorangehenden Ansprüche, dadurch gekennzeichnet, daß die Zwischenschicht oder der Nerv (9, 9A, 9B, 9C, 9D, 9E, 9F) eine Härte aufweist, die größer als 45 Shore D ist.
  19. Sohle gemäß irgendeinem der vorangehenden Ansprüche, dadurch gekennzeichnet, daß die Schicht (7, 7A, 7B) für den Kontakt mit dem Boden eine Härte aufweist, die kleiner als 45 Shore D ist.
  20. Sohle gemäß irgendeinem der vorangehenden Ansprüche, dadurch gekennzeichnet, daß die Komfortschicht (8, 8A, 8B) eine Härte aufweist, die kleiner als 80 Shore A ist.
  21. Sohle gemäß irgendeinem der vorangehenden Ansprüche, dadurch gekennzeichnet, daß die Schicht (7, 7A, 7B) für den Kontakt mit dem Boden aus einem Gummi ist, der Eigenschaften bezüglich der Haftung und des Widerstandes gegenüber Abreibung aufweist.
  22. Sohle gemäß irgendeinem der Ansprüche 1 bis 20, dadurch gekennzeichnet, daß die Schicht (7, 7A, 7B) für den Kontakt mit dem Boden aus einem thermoplastischen Material ist.
  23. Sohle gemäß irgendeinem der vorangehenden Ansprüche, dadurch gekennzeichnet, daß die Zwischenschicht oder der Nerv (9, 9A, 9B, 9C, 9D, 9E, 9F) aus einem thermoplastischen Material ist.
